ONLINE STORE TERMS AND CONDITIONS

ONLINE STORE TERMS AND CONDITIONS

Current version · Applies to all plans: Lanzar, Crecer, Escalar, and A la Medida

1. Service Scope

The services offered by Eleven Estudio are strictly limited to what is established in the plan contracted by the client (Lanzar, Crecer, Escalar, or A la Medida), as detailed in the accepted quotation proposal. Any functionality, section, product, application, or element not expressly included in said plan falls outside the scope of service.

Additional sections, extra revision rounds, product uploads above the plan limit, additional applications, and any other requirements outside the contracted package will be quoted and invoiced independently, following written approval from the client.

Eleven Estudio reserves the right to present a complementary quotation for requests that exceed the scope of the current plan.

2. Multimedia Content and Visual Material

The client is responsible for providing their own multimedia content to be used in their store: product photographs, videos, banners, logos, icons, and any other visual element. Eleven Estudio will use said material as the primary input for the development and design of the store.

In the event that the client does not have suitable visual material for any section or element of the site, Eleven Estudio may use stock content (images, icons, illustrations, or other free-to-use visual resources) subject to availability and the design team's discretion. This stock content is referential and can be replaced by the client's own material at any time.

Furthermore, Eleven Estudio may use Artificial Intelligence tools to generate specific content (texts, images, graphic elements, or others) when the material provided by the client is not sufficient or suitable for a certain section of the project. The use of AI will be aimed at improving the quality and visual and textual coherence of the site.

For best results, it is recommended that the client provide quality photographic material in digital format before development begins.

3. Adaptation and Preparation of Product Images

The editing, cropping, optimization, and adjustment of the client's product images are the responsibility of the client. Eleven Estudio does not include photography services, photo retouching, or advanced product image editing within the standard plans.

However, Eleven Estudio will recommend the optimal sizes, formats, and technical specifications so that images are displayed correctly in the store, and will provide access to free-to-use platforms and tools that the client can use autonomously to prepare their visual material.

Eleven Estudio may quote image editing or adaptation services independently if the client requires it.

4. Uploading Products to the Catalog

Eleven Estudio will be responsible for entering into the store's catalog only the quantity of products established in the contracted plan: 10 products in the Lanzar plan, 25 in Crecer, 50 in Escalar, or the quantity agreed upon in the A la Medida plan. The entry of additional products, as well as the ongoing management and updating of the catalog, is the responsibility of the client and their team.

If the client wishes Eleven Estudio to handle the loading of additional products beyond those included in their plan, this service can be quoted separately. The fee is variable and is established per product, considering factors such as the number of variants, attributes, descriptions, images, and other details associated with each product. The greater the complexity of the product, the higher the cost per unit.

To request an additional product loading quote, the client must provide the complete inventory with all required details (name, description, price, variants, images, etc.) so that Eleven Estudio can accurately estimate the cost.

The product loading service is available for all plans and can be contracted at any time, even after the store's launch.

5. Integrations and Automations

Eleven Estudio's plans do not include integrations with external systems (ERP, CRM, logistics platforms, inventory systems, marketplaces, etc.) or workflow automations, unless explicitly specified in writing in the contracted proposal.

If the client requires any type of integration or automation, they must request it formally so that Eleven Estudio can prepare an additional quotation. The implementation of these services will be subject to a separate agreement.

6. Online Store Payment Platforms and Methods

Eleven Estudio advises the client on the payment methods available and compatible with their Shopify store (credit card, cash on delivery, payment link, bank transfer, among others), but does not operate, manage, or handle third-party collection platforms integrated into the store.

The recommendations of payment providers made by Eleven Estudio are merely indicative. Eleven Estudio has no commercial relationship, agreement, economic interest, control, nor receives any benefit from any payment gateway or platform. The contracting, final configuration, fees, commissions, disputes, chargebacks, refunds, and any incident related to transactions are the sole responsibility of the client and the payment service provider companies.

For any problem related to payments, transactions, or funds, the client must contact the corresponding payment platform directly.

7. Use of Projects as Portfolio

Eleven Estudio reserves the right to display projects developed for its clients as part of its commercial portfolio, both in digital media (website, social networks, presentations) and in printed materials or any other communication channel, for the sole purpose of illustrating the quality and type of work performed.

If the client does not wish for their project to be used as a portfolio reference, they must request it explicitly and in writing before the store's launch. This request must be received and confirmed in writing by Eleven Estudio to be valid. In the absence of such a request, it is understood that the client grants their consent for the use of the project for portfolio purposes.

The request for project confidentiality must be made before final delivery. Retroactive requests will not be accepted.

8. Site Ownership and Hosting

Once the project is completed and delivered, the store is the total property of the client from day one. Eleven Estudio does not retain rights over the developed site. The client must contract and maintain an active Shopify plan directly with said platform, which is responsible for hosting, platform updates, technical maintenance, and SSL security certificates.

Eleven Estudio has no responsibility for interruptions, policy changes, updates, or any modifications that Shopify makes to its platform unilaterally.

9. Delivery Times

Estimated development times are referential and may vary according to the complexity of the project, the client's punctuality in delivering materials (texts, images, logos, product information), and the fluidity in revision rounds. As a general reference: the Lanzar plan takes between 2 and 3 weeks; Crecer between 3 and 4 weeks; Escalar between 4 and 6 weeks; A la Medida can take 6 weeks or more depending on the agreed scope.

The start of development is conditioned on the receipt of the corresponding payment as agreed, as well as the timely delivery of the necessary materials by the client.

10. Revisions

Each plan includes a specific number of revision rounds: 2 for Lanzar and Crecer, 4 for Escalar, and 6 for A la Medida. A revision round is defined as a consolidated delivery of adjustments and comments by the client. Revisions must be carried out in an orderly and centralized manner; fragmented comments or those sent at different times outside of a formal round may not be considered within the same cycle.

Additional revision rounds exceeding those included in the plan will be quoted and invoiced separately, upon request by the client.

11. Post-Launch Support

The Lanzar and Crecer plans include 15 days of support following the store's launch. The Escalar and A la Medida plans include 30 days. During this period, Eleven Estudio will provide assistance to resolve operational doubts and minor adjustments related to the delivered store.

Additional support, training, and consulting outside the included period can be contracted from USD 17 per hour or its equivalent in local currency, subject to team availability.

12. Client Requirements

For the enabling of online payment methods (credit card, transfers, etc.), the client's business must be operating legally in their country, have current documentation, and have a bank account in the currency in which they wish to receive payments. Eleven Estudio is not responsible for delays or rejections in the activation of payment methods resulting from non-compliance with these requirements.

13. Commitment to Quality and Continuous Improvement

Eleven Estudio is committed to delivering quality, functional, useful, and scalable work for each client. Each store is developed with attention to detail, focus on user experience, and considering the future growth of the business.

The Eleven Estudio team is constantly training and updating in the latest trends in web design, e-commerce, digital platforms, and industry best practices, with the aim of always offering the most appropriate and updated solutions to its clients.

Our commitment is to build a long-term relationship of trust, based on transparency, clear communication, and the delivery of results that drive the growth of our clients' businesses.

14. Modifications to these Terms

Eleven Estudio reserves the right to update or modify these terms at any time. Changes will be communicated to active clients and will be available in the contractual documents in effect at the time of contracting.
